1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of GetGamma (the "Service"), operated by A&D Tech Solutions LLC ("Company," "we," "us," or "our"), a New Jersey limited liability company. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
GetGamma is an analytical and informational tool that provides gamma exposure analysis and related market data for educational and research purposes. The Service does not execute trades, provide personalized investment advice, or manage any user funds or brokerage accounts.
3. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use this Service. By using GetGamma, you represent and warrant that you meet these requirements.
4. Account Registration
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
5. Marketing Communications
By creating an account and agreeing to these Terms, you consent to receive marketing and promotional communications from us — including emails about new features, product updates, offers, educational content, and related opportunities we believe may be of interest to you — at the email address associated with your account. You may opt out of marketing communications at any time by using the unsubscribe link in any such email or by contacting us at support@getgamma.xyz. Opting out will not affect transactional or account-related messages (e.g., billing, security, and support), which are necessary to provide the Service. 6. Subscriptions and Payment
GetGamma offers both free and premium subscription tiers. Premium subscriptions are billed monthly at the rate displayed at the time of purchase. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are non-refundable, as described in our Refund Policy.
7. Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period, after which your access to premium features will terminate. No partial refunds or credits will be issued for unused portions of a subscription period.
8. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service or its systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission; or (e) use automated means to access the Service except as expressly permitted.
9. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of A&D Tech Solutions LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, A&D TECH SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify, defend, and hold harmless A&D Tech Solutions LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New Jersey.
